Terms of Service

These Terms govern your use of Momentary (the "Service"), a voice-first AI journaling service provided by MinaLabs (the "Company"). By signing up for or using the Service, you agree to these Terms.

1. Definitions

  • Service: Momentary and related features that transcribe your voice and use AI to generate journal entries ("moments") and reflections.
  • User: anyone who uses the Service under these Terms.
  • PRO: extended features available through a paid subscription.
  • Content: the voice/text you provide and the journals/reflections generated from it.

2. Changes to these Terms

  • These Terms take effect when posted in the Service.
  • We may update these Terms within the limits of applicable law. We will announce the effective date and material changes in advance, with reasonable notice for significant changes.

3. Accounts

  • Using the Service requires sign-in via Google, Kakao, or Apple.
  • You are responsible for your account. Notify us immediately if you become aware of unauthorized use.

4. Provision and changes to the Service

  • We strive to provide the Service continuously, but it may be temporarily interrupted due to maintenance, failures, or events beyond our control.
  • We may improve or change the Service and will announce significant changes in advance.

5. AI-generated content notice

  • Journals, reflections, mentor replies, and quotes are generated automatically by AI and may be inaccurate or inappropriate. We do not warrant their accuracy, completeness, or suitability.
  • The Service is a tool for self-reflection and journaling and is not a substitute for medical care, mental-health treatment, or professional counseling. If you are struggling, please seek help from a qualified professional. In an emergency, contact your local emergency services.

6. Paid service (PRO) and subscriptions

  • We offer a free plan and a paid subscription (PRO).
  • Pricing: on the web, US$5.99/month or US$49.99/year (in Korea, ₩7,900/month or ₩66,000/year). Currency and whether tax is included are shown at checkout and may be displayed in your local currency based on your location.
  • Web payments (Merchant of Record): web subscriptions are processed by Paddle (Merchant of Record). Billing, tax handling, and receipts are performed by Paddle as the seller of record, and payment-method data (e.g., card details) is handled directly by Paddle (we do not store it).
  • Auto-renewal: subscriptions renew automatically for the selected period (monthly/yearly), and the applicable fee is charged at renewal. Cancel before the next billing date to stop renewal.
  • Cancellation: you may cancel anytime in the app's settings or the payment provider's customer portal. After cancellation, PRO remains active until the end of the period you already paid for.
  • Refunds / withdrawal: refunds follow our Refund Policy and applicable law.
  • Native apps (iOS/Android): where in-app subscriptions are offered, the respective app store's (App Store/Google Play) billing, renewal, and refund policies also apply.
  • We may change pricing or plans; for existing subscribers, changes apply from the next renewal after prior notice.

7. Your responsibilities

You must not:

  • submit content that infringes others' rights or violates law or public order;
  • disrupt the Service, or access, copy, or reverse-engineer it without authorization;
  • generate abnormal traffic/requests via automated means.

8. Rights in Content

  • You retain rights to the Content you provide and the journals/reflections generated from it.
  • You permit the Company to process your Content only as needed to provide the Service (transcription, generation, storage, display). We do not use your Content beyond this scope.
  • Content processing is governed by our Privacy Policy.

9. Restriction and termination

  • You may delete your account anytime in settings; deletion permanently destroys your Content.
  • We may restrict use or terminate an account that violates these Terms, after notice (or after the fact in urgent cases).

10. Disclaimers and limitation of liability

  • The Service is provided "as is," and we disclaim warranties to the extent permitted by law.
  • We do not warrant AI-generated output and limit our liability for reliance on it to the extent permitted by law.
  • We are not liable for damages caused by events beyond our control, including third-party services (auth, AI, payments, email).

11. Governing law and disputes

  • These Terms are governed by the laws of the Republic of Korea, and disputes follow the procedures provided by applicable law.
  • These Terms are provided in Korean and English; in case of any conflict, the Korean version prevails.
